1. Agreement

These terms of use (the “Terms”) govern your use of the App and any related services we provide (together, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

2. Eligibility

You must be able to form a legally binding contract where you live. If you use the Service on behalf of an organisation, you confirm you have authority to bind that organisation.

3. Your account

You are responsible for your account and for keeping your login credentials secure. You must provide accurate information and keep it reasonably up to date.

We may suspend or terminate accounts where we reasonably believe there is misuse, a security risk, or a breach of these Terms.

4. What the Service does

The Service helps you create, organise, share, sync, and manage professional contacts, including connection features that allow contact details to be shared or kept up to date between connected users where enabled.

Features may change over time.

5. Your content and contact data

a. Your content

“Your content” includes contact records, profile and card details, contact images, reports, support messages, notes, and any other content you submit or store via the Service.

You retain ownership of your content.

b. Licence to operate the Service

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, transmit, display, and adapt your content only as needed to provide, maintain, secure, support, and improve the Service.

c. Content about other people

If you upload, import, sync, share, or store someone else’s contact details, you are responsible for ensuring you have the right to do so.

d. Feedback

If you provide feedback or suggestions, you grant us the right to use them without restriction or compensation.

6. Connections, sharing, blocking, and safety

If you choose to connect with another user, you may share certain contact details with them and receive updates, depending on your settings and theirs.

You can block or disconnect from users using in-app controls. We may also offer reporting tools. You agree not to misuse these tools, including by making knowingly false reports.

7. Acceptable use

You must not:

  • harass, threaten, defame, or abuse others;
  • impersonate any person or misrepresent your affiliation;
  • upload or share unlawful content, or content that infringes intellectual property, confidentiality, publicity, or privacy rights;
  • upload, import, sync, or share contact details unless you have the right to do so;
  • attempt to access, probe, scrape, overload, disrupt, or compromise our systems or other users’ data;
  • reverse engineer or bypass access controls, except where the law permits this;
  • use the Service to send spam or bulk unsolicited communications;
  • use the Service in a way that breaches applicable law.

We may remove content or restrict access where we reasonably believe this section has been breached.

8. Privacy

Our privacy policy explains how we collect and use information. By using the Service, you acknowledge our privacy policy.

9. Subscriptions and billing

Some features may require a paid subscription. If you subscribe through Apple in-app purchase, Apple manages payment, renewal, cancellation, refunds, and billing details under your Apple Account and Apple’s terms.

Subscriptions may auto-renew until cancelled. You can manage or cancel Apple subscriptions in your Apple Account subscriptions. Deleting your Qooee account does not cancel Apple billing.

Feature availability may depend on your plan, account state, device, territory, App Store availability, or technical requirements.

10. Account deletion and termination

You can stop using the Service at any time. You can request account deletion in the App or by contacting us.

Account deletion covers the Qooee account record and personal data controlled by Qooee, subject to legal, security, fraud prevention, billing, audit, and dispute-resolution retention requirements. Account deletion does not cancel Apple billing, remove Apple Contacts entries from your device unless you separately remove them, or delete records another user independently stores.

We may suspend or terminate your access if we reasonably believe you have breached these Terms, created risk for other users, or created legal exposure for evil robots.

Upon termination, your right to use the Service ends. We may delete or de-identify your content in line with our privacy policy and retention practices.

11. Intellectual property

The Service, including its software, design, text, branding, trade marks, and other materials, is owned by evil robots or its licensors and is protected by applicable laws.

You receive a personal, non-transferable, non-exclusive, revocable licence to use the App for its intended purpose, subject to these Terms.

12. Third-party services

The Service may integrate with or depend on third-party services, such as Apple services, Google Sign-In, Firebase Authentication, cloud hosting, database services, and App Store in-app purchase services. Third parties may have their own terms and policies. We are not responsible for third-party services.

13. App Store terms and Apple

If you downloaded the App from Apple’s App Store, you also agree to any applicable Apple terms.

Apple is not a party to these Terms, does not provide the Service, and is not responsible for it. To the extent permitted by law, Apple is a third-party beneficiary of these Terms and may enforce them against you.

14. Disclaimers

The Service is provided “as is” and “as available”. We do not promise that the Service will be uninterrupted, error-free, secure, or that stored information will never be lost.

You are responsible for verifying and backing up important information where appropriate.

Nothing in these Terms excludes consumer guarantees, warranties, rights, or remedies that cannot be excluded under law, including under the Australian Consumer Law.

15. Limitation of liability

To the maximum extent permitted by law, evil robots will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.

To the maximum extent permitted by law, evil robots’ total liability for any claim relating to the Service is limited to the amount you paid to evil robots for the Service in the 12 months before the event giving rise to the claim, or AUD $50 if you have not paid anything.

16. Indemnity

To the extent permitted by law, you agree to indemnify evil robots against claims arising from your misuse of the Service or breach of these Terms, including your content and your interactions with other users.

17. Changes

We may update these Terms from time to time. If changes are material, we will provide notice in the App or by other reasonable means. Continued use after the effective date means you accept the updated Terms.

18. Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of Australia.

If you live outside Australia, you may also have mandatory rights under your local consumer laws.
